Wesharez Terms of Service

BY USING OUR WEBSITE YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY

Introduction

These Terms of Service govern your use of Wesharez and your agreement with us. Here are a few key things to note:

  • We can modify these Terms of Service at any time.

  • If you purchase a Subscription, it will automatically renew unless you cancel it.

  • Your rights may vary depending on where you live.

  • If a dispute arises between you and us, you agree to notify us and agree to mediation before bringing any claim.

Interpretation

In these Terms of Service:

  • "Wesharez" refers to our website and services accessible via www.wesharez.com.

  • "We", "our", and "us" refer to WESHAREZ LTD, the operator of Wesharez.

  • "User" refers to any person using Wesharez, including Creators, Fans, and Referring Users.

  • "Creator" means a User who uploads or shares Content on Wesharez for Fans to view.

  • "Fan" means a User who follows or interacts with Creators’ Content.

  • "Content" includes all material uploaded or shared on Wesharez (videos, photos, livestreams, text, etc.).

  • "Creator Earnings" means payments earned by a Creator from Fans after platform fees and taxes.

  • "Subscription" means a recurring payment to access a Creator’s Content.

  • "Monetization Features" include earning revenue through content sales, tips, or subscriptions.

  • "You" or "your" means the person agreeing to these Terms.

Eligibility and Age Requirements

  • Minimum Age: You must be at least 13 years old to use Wesharez.

  • Users aged 13–17 may use Wesharez only with verified parental or guardian consent.

  • Monetization and payment features (including receiving donations, commissions, or payouts) are available only to users aged 18 or older, or 13–17 with verified parental consent.

  • Verification may require submitting identification and completing our Parental Consent Verification Process.

  • If we discover a user under 13 has created an account, or that a user under 18 is monetizing without proper consent, the account will be suspended or terminated in compliance with applicable child protection laws.

Account Registration

To register on Wesharez, you must:

  1. Provide accurate information, including a valid email address and password.

  2. Agree to our Terms of Service and Privacy Policy.

  3. Be legally allowed to use the platform in your jurisdiction.

Creators must also:

  • Upload valid ID and proof of age.

  • Provide bank details or payment methods for earnings.

  • Pass additional verification checks when required.

We may reject or terminate any account at our discretion.

Content and Conduct

  • You are responsible for all Content you post.

  • Content must comply with our Acceptable Use Policy and applicable laws.

  • You must own or have rights to any Content you upload.

  • Content involving others must have their written consent and proof of age (18+).

  • We may review, remove, or restrict access to Content that violates our policies.

You agree to act as custodian of records for all Content you upload.

Monetization and Creator Earnings

  • Fan Payments and Subscriptions are processed by approved payment providers.

  • Wesharez charges an 8% fee on all Fan Payments.

  • Creator Earnings can be withdrawn once your balance meets the minimum payout threshold.

  • All transactions are processed in USD.

  • Users under 18 require verified parental consent to access any monetization features.

  • We may withhold or reverse payments related to fraud, chargebacks, or Terms violations.

Taxes

Creators are responsible for all applicable taxes in their jurisdiction.
Wesharez does not withhold or file taxes on behalf of Creators.
Creators registered for UK or EU VAT must comply with relevant VAT laws.

Use of AI and Advertising Content

Creators must clearly label:

  • Sponsored or Paid Content using tags like #ad or #sponsored.

  • AI-generated Content using tags like #AI or #AIGenerated.

Advertising Content must comply with local laws and cannot promote illegal, harmful, or age-restricted products to minors.

Prohibited Content

You may not upload or share:

  • Sexual content involving minors.

  • Hate speech, violence, or harassment.

  • Content promoting illegal activities.

  • Misleading, spam, or deceptive material.

Violation of these rules may result in account termination and legal reporting.

Intellectual Property Rights

You retain ownership of your Content. However, by uploading to Wesharez, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your Content as necessary for operating the platform.

We do not sell your Content to other platforms, but if Wesharez or its assets are sold, this license may transfer to the new owner.

Account Suspension or Termination

We may suspend or delete your account without prior notice if:

  • You violate these Terms or our policies.

  • You use Wesharez for illegal or fraudulent purposes.

  • You are under 13 or monetizing without verified consent.

If your account is terminated, you lose access to your Content and Earnings.

Limitation of Liability

To the extent permitted by law:

  • Wesharez is not liable for indirect or consequential damages, loss of profits, or data loss.

  • Our total liability to any User will not exceed USD $5,000 or the total fees paid to us in the preceding 12 months, whichever is greater.

Dispute Resolution

Before filing a legal claim, you agree to:

  1. Notify Wesharez of any dispute via email at support@wesharez.com.

  2. Participate in mediation if requested.

For Consumers:

  • The laws of England and Wales apply.

  • UK and EU users may file claims in their local courts.

  • US users agree to jurisdiction in Wilmington, Delaware.

For Business Users:

  • English law and the courts of England and Wales have exclusive jurisdiction.

Changes to the Terms of Service

We may modify these Terms at any time to reflect legal, operational, or policy changes.
If we make significant changes, we will notify you via email or in-app notice before they take effect.
Continued use of Wesharez after changes means you accept the updated Terms.

Account Deletion

You may delete your Wesharez account at any time.
If you are a Creator, your account will remain active until all active subscriptions expire.
After deletion, we will handle your data according to our Privacy Policy.

General

  • These Terms constitute the entire agreement between you and Wesharez.

  • If any provision is found unenforceable, the remaining provisions will continue in effect.

  • You may not assign your rights under these Terms without our consent.

  • We may assign or delegate our rights and obligations under these Terms at any time.
